If the tenant is a limited company with no money, can I pursue the director personally?

Generally, a limited company has independent legal status, so you can only pursue the company. Unless the director provided a 'Personal Guarantee', it is difficult to pursue their personal assets directly. This is why we recommend using a 'Statutory Demand' to pressure corporate tenants.

The tenant has disappeared but didn't return keys. Can I change the locks myself?

Absolutely not. Even if the unit seems empty, the tenant legally retains possession. Changing locks without authorization may constitute 'illegal entry' or 'harassment', exposing you to criminal liability or civil claims. You must obtain a possession order from the Lands Tribunal and have it enforced by a bailiff.

How long does the repossession process usually take?

In straightforward cases, it takes about 3 to 4 months from filing with the Lands Tribunal to official repossession by the bailiff. If the tenant contests or applies for adjournment, it may take 6 months or more.

Can I sell the tenant's equipment, fixtures, or goods to offset the debt?

You cannot sell them directly. After obtaining a possession order, you must apply for an 'Order for Sale' or 'Disposal Order'. Items must be inventoried and handled under bailiff supervision; otherwise, the tenant can sue you for illegal disposal of property.

Can I file for repossession if the tenancy agreement is not stamped?

The court typically will not accept an unstamped lease as evidence. You must first pay the stamp duty and any penalties (up to 10 times the tax amount) before the court will process your application.

Can I repossess if the tenant only pays partial rent (e.g., 70%)?

Yes. Failure to pay rent in full by the deadline constitutes a breach. You have the right to refuse partial payment and insist on starting repossession proceedings.

Can I cut off water and electricity during the repossession process?

Extremely dangerous. Cutting off utilities may be considered illegal harassment, affecting the tenant's business. This gives the tenant grounds to counterclaim and may even lead the court to refuse your possession order.

What is a 'Statutory Demand'? Is it effective for retail tenants?

What if the property is damaged and the deposit isn't enough to cover it?
