The Challenge

Mr. Cheung owned a retail shop in Mong Kok, leased to a fashion boutique operator. Business was good initially, but post-pandemic difficulties led to rent arrears. Frustratingly, the tenant continued operating while claiming inability to pay. With 3 months' arrears totaling $150,000, Mr. Cheung was caught between fear of legal action and unwillingness to accept losses.

Our Solution

  1. Assessed seizure viability: On-site inspection confirmed sufficient valuable goods for seizure.
  2. Dual-track legal action: Simultaneously applied for repossession and distress warrant, creating dual pressure.
  3. Executed seizure: Coordinated bailiff entry to inventory and seize goods. Tenant immediately softened stance.
  4. Negotiated full payment: Tenant paid all arrears within 2 weeks and voluntarily vacated to avoid auction.

The Result

The tenant immediately sought settlement, paying all $150,000 arrears within 2 weeks and voluntarily vacating. Mr. Cheung recovered all losses and quickly found a new tenant at 10% higher rent.

Value Added

  • Strategic legal action: Utilized distress warrant, forcing the operating tenant to address the issue.
  • Maximized recovery: Recovered property and all arrears, truly protecting landlord interests.
  • Quick turnaround: Entire process took only 2 weeks.
“Distress warrants are more effective than repossession for tenants still operating.”

The Challenge

Mr. and Mrs. Wong retired and rented out their ancestral village house to supplement medical expenses. Due to the remote location, they signed a tenant willing to prepay six months' rent. After six months, the tenant vanished. The elderly couple couldn't travel far to handle the situation. Worse, neighbors complained of strangers and noise, suspecting illegal activities.

Our Solution

  1. Clarified land titles: Village house title documents are complex. We immediately helped locate key deeds from old documents to ensure legal proceedings could proceed.
  2. On-site inspection and warning: Team personally visited the village to post formal legal warning notice at the unit entrance.
  3. Coordinated with bailiff: Provided accurate location and route to village, pre-arranged locksmith at village entrance to ensure smooth operation.
  4. Professional disaster scene handling: On repossession day, walls were covered in graffiti, taps left running causing flooding, ceiling peeling. Our team remained calm and professional.

The Result

Successfully recovered the property. Facing severe damage, we immediately: 1. Documented all damage as ironclad evidence; 2. Shut off utilities and arranged emergency repairs; 3. Installed high-security locks and posted notices. Successfully minimized client's losses and risks.

Value Added

  • Experience with complex cases: Familiar with practical challenges of special properties like village houses.
  • Crisis management execution: Orderly crisis handling in disaster-like situations to minimize damage.
  • One-stop solution: From legal procedures to on-site coordination to post-disaster handling and repair referrals.

Common Questions

Village Repossession FAQ

We have compiled the most common legal and practical questions about repossession to help you understand your rights.

Does the alienation restriction period (Ding Uk) affect repossession?

The restriction period only limits the transfer of ownership, not the right to repossess. You can still pursue rent arrears and repossession. However, if multiple owners or Tso/Tong land are involved, ownership status and authorization must be confirmed first.

The tenant has disappeared; can I change the locks myself?

No. Changing locks yourself may constitute illegal occupation, leading to criminal liability or civil lawsuits. The court may also refuse to grant a possession order because of this. You must execute this formally through a bailiff.

Will an unstamped tenancy agreement affect the repossession application?

It poses a risk. Unstamped agreements may not be accepted as evidence in court. We recommend using bank transfer records and communication logs as supplementary evidence, and stamping the agreement retroactively (penalties apply) as soon as possible.

The property has multiple owners; can I start repossession alone?

No. All owners must agree and authorize the action. You need written authorization from all owners before starting the procedure.

The property is Tso/Tong land; how can I start repossession?

A clan meeting must be convened to obtain consent from all managers. The process involves notification, meeting, voting, and written resolution, which may take weeks to months. We recommend preparing early.

Will the remote location of the village house extend the repossession time?

The application phase is unaffected, but the execution phase may have challenges. Bailiff scheduling may take longer, and accessing the property may involve right-of-way issues. We will plan logistics in advance.

Can I start repossession immediately after 15 days of rent arrears?

Yes. Arrears exceeding 15 days is the statutory threshold. However, we recommend issuing a written payment reminder first to give the tenant a final chance, while preparing all necessary documents.

How should I handle furniture left behind by the tenant?

You cannot dispose of it unilaterally. You need to apply to the court for an Order for Sale or Disposal Order, post a statutory notice, and wait for the specified period before handling it. We will assist with the application and clearance coordination.

If accessing the village house requires passing through private land, will the bailiff refuse to execute?

Usually not. We will contact the land owner in advance to obtain an access agreement. If unachievable, the bailiff may seek alternative routes or apply for court directions.

Will an uncontactable tenant stop the repossession application?

No. Substituted service procedures can be used. Notices are posted at the property entrance for 3 consecutive days, followed by an affirmation at the Lands Tribunal. Once completed, the repossession application can proceed.
