Can I file immediately if tenant is 15 days late on rent?

Yes. Under the Landlord and Tenant (Consolidation) Ordinance, rent arrears exceeding 15 days constitutes a fundamental breach. Landlords can terminate the tenancy and apply for repossession and rent recovery orders.

What if the tenancy agreement is not stamped or CR109 not submitted?

If the tenancy agreement is not stamped or residential tenancy CR109 is not submitted, the court will refuse to accept the application. Landlords must complete these first and may face penalties.

How do I repossess the property after winning the case?

After the court issues the possession order, the bailiff will deliver an eviction notice giving the tenant 7 days to vacate voluntarily, then enforce repossession.

Are there special procedures for subdivided units?

Yes. Subdivided units are regulated tenancies requiring special forms and compliance with Part IVA regulations.

Do I need separate applications for repossession and rent recovery?

No. The Lands Tribunal allows combined applications for property possession and rent recovery in the same proceedings, with additional distress warrant applications available.

What is the first step after submitting the application?

Submit the application and Form 22 to the Lands Tribunal, then serve the tenant within 7 days and post a notice for at least 3 days.

How long does the process take?

If uncontested, the entire process can take approximately 2-3 months. If a hearing is needed or the tenant contests, it may take 4 months or longer.

What if the tenant has already moved out?

You still need to apply for a repossession order to obtain legal confirmation and enforcement rights. You cannot handle this yourself.
